Terms Of Use
Triweb is a new, novel, and experimental web platform (further also referred to as "Triweb Platform") which is developed and made available by Shore Labs Zbigniew Zemła (further also referred to as "We", "Us", "Our", or "Shore Labs"). These Terms of Use (further also referred to as “Agreement”) govern your use of the Triweb Platform.
The Triweb Platform, including any related materials, documentation, software, or services, is provided “as is” and "as available" without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose and noninfringement. In particular, computer software, networking, and security are complex and evolving fields, and no representations, claims, or warranties regarding the security, correctness, accuracy, completeness, availability, or reliability of the Triweb Platform, including any related materials, documentation, software, or services are being made.
To the fullest extent allowed by applicable law, in no event shall We, our affiliates, suppliers, contractors, or employees be liable for any claim, damages, or other liability, whether in an action of contract, tort or otherwise, arising from, out of, or in connection with the use, inability to use, or other dealings in the Triweb Platform, any related materials, documentation, software, or services.
If you implement or use the Triweb Platform in your software, you agree to indemnify, defend, and hold Us harmless from and against all third-party claims, liabilities, damages, costs, and losses arising as a result of such implementation or use.
To the fullest extent allowed by applicable law, the entire aggregate liability of Shore Labs, its contractors, or employees, in all matters or claims related to this Agreement or to the Triweb Platform (including any related software or services) shall be limited to 10 PLN (ten polish złoty).
All rights, including all intellectual property rights in the Triweb Platform, and any related materials, documentation, software, or services provided by Us are reserved. We grant you a worldwide, non-transferable, non-exclusive, limited license without the right to grant further licenses to use the software belonging to Us that is made available as a part of the Triweb Platform during the period of your use of the Triweb Platform. This license is intended solely to enable you to use the Triweb Platform as permitted by the Terms Of Use.
You may not copy, modify, create derivative works of, reverse engineer, decompile, or otherwise attempt to extract the source code of the software or any part thereof, or allow any third party to do so, unless expressly permitted or required by law, or if you have received written consent from Us.
None of the provisions of these Terms Of Use implicitly grant you any rights, powers, title, or ownership or constitute consents, except those expressly indicated in these Terms Of Use. To avoid any doubts, these Terms Of Use only grant You the right to use the Triweb Platform to the extent specified in the Terms Of Use, and do not transfer any rights belonging to Us.
The Triweb Platform is evolving, and this, too, is a living document. We will notify you about upcoming changes to the Terms Of Use that may negatively affect your rights or obligations in advance through appropriate means, including by displaying an update notice on this page. Your continued use of the Triweb Platform, including any related materials, software, or services after the changes take effect will be considered as your agreement to such changes.
Should any provision of this disclaimer be determined by a court of competent jurisdiction to be void, invalid, or unenforceable, such provision shall be amended and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions shall continue in full force and effect.
Any disputes or claims shall be governed by and construed in accordance with the laws of the Republic of Poland. Parties agree to submit to the exclusive jurisdiction of the competent courts located in Poland. Notwithstanding the above, We may seek immediate injunctive relief in any court with jurisdiction over the matter in circumstances where such relief is necessary to prevent irreparable damage.
